Terms of Service

These terms are entered into between Eastside Jiu-Jitsu ("Eastside Jiu-Jitsu") and You ("the Member").

Services

The membership entitles use of Eastside Jiu-Jitsu’s facility and services during open hours. It cannot be shared.

Age Limit

Members must be 18 or older. For those under 18, a parent or guardian must sign this agreement and the accompanying waiver.

Membership Types and Contractual Obligations

  1. Annual Membership:

    • Members commit to a 12-month contract.

    • Payment is billed annually upfront.

    • Membership automatically renews at the end of the term unless cancelled via email 30 days before renewal.

    • No refunds are provided for any dues paid under this membership, except as required by law (e.g., cancellation within statutory periods as per the Consumer Protection Act of Ontario).

    • Early termination is not permitted, except in cases of injury or relocation, which must be supported by official documentation and may be subject to a cancellation fee reflecting actual costs incurred.

  2. Committed Membership:

    • Members commit to a 12-month contract.

    • Payment is billed biweekly.

    • Membership automatically renews biweekly at the agreed rate.

    • Members must honor the full 12-month term. Early termination is subject to a cancellation fee, which will be the lesser of:

      • The difference between the total amount paid for the Committed Membership and what would have been paid for the Flexible Membership for the time elapsed, or

      • 50% of the remaining balance on the contract term.

    • Refunds are only provided for dues already paid if cancellation occurs within statutory periods outlined by Ontario's Consumer Protection Act.

  3. Flexible Membership:

    • There is no long-term commitment; members may cancel at any time by providing email notice.

    • Payments are billed biweekly, and training is offered on-demand.

    • No refunds are provided for any dues paid under this membership.

Suspension/Termination of Membership

Eastside Jiu-Jitsu reserves the right to suspend or terminate membership if the Member breaches the code of conduct, interferes with others, or fails to pay fees. Members may cancel membership via email based on the terms of their selected membership plan, in compliance with applicable laws.

Payments

The Member agrees to pay all fees as stated in the membership plan they select. Late payments may result in suspension of access and additional debt collection fees. Payment obligations remain even if access is blocked, and access will be restored once all debts are cleared. No refunds are given for any dues already paid, except as required by applicable consumer protection laws.

Membership Suspension

Members may suspend their membership once every 12 months, for up to 2 months. Suspension requests must be made via email and cannot be applied retroactively. This applies to Annual and Committed Memberships only. Suspension is subject to the terms allowed under Ontario law.

Price Changes

For members selecting the Annual or Committed membership plans, prices are fixed for the duration of their 12-month contract. No price changes will apply during this period. After the initial 12-month term, Eastside Jiu-Jitsu reserves the right to adjust prices, with a minimum notice of 60 days before any increase takes effect. Flexible membership prices are subject to adjustment with 30 days’ notice. All price changes will comply with the Consumer Protection Act and will not affect members until the end of their current contract period.

Communication

All official communications will be conducted via email. It is the Member’s responsibility to provide a valid email address and ensure receipt of communications. Eastside Jiu-Jitsu will comply with Ontario's Consumer Protection Act regarding cancellation and renewal notices, ensuring clear and transparent communication about contract terms.

Health & Safety

The Member acknowledges responsibility for ensuring their health is suitable for participation. Members are advised to seek medical advice if necessary. Eastside Jiu-Jitsu is not liable for injuries related to pre-existing health conditions unless caused by negligence or improper facility management. 

Liability

Members are responsible for any damage they cause to property or for injuries they cause to others. They are required to cover the costs upon presentation of a statement. Liability waivers do not absolve Eastside Jiu-Jitsu from responsibility in cases of gross negligence or willful misconduct, in accordance with Ontario law.

Waiver of Liability

The use of Eastside Jiu-Jitsu’s facilities and equipment is at the Member’s own risk. Eastside Jiu-Jitsu shall not be liable for injuries, property damage, or other claims arising from the use of the premises or equipment unless caused by gross negligence or willful misconduct. Waivers are enforceable only to the extent permitted by Ontario laws, which do not allow businesses to completely exclude liability for negligence in some situations.

Open Roll

The Member acknowledges that "Open Roll" sessions are unsupervised. They assume full responsibility for their actions during these sessions. A waiver must be signed to participate in "Open Roll", and Eastside Jiu-Jitsu is not liable for injuries sustained during unsupervised activities unless caused by gross negligence.
